This Privacy Policy applies to the Website (as defined below) operated by The Kennedy Organization, LLC, an Illinois limited liability company (the “Company”, “we” or “us”).

By accessing and using the Website, you acknowledge and agree to abide and be bound by this Privacy Policy and you expressly consent to our collection, use, and disclosure of your Personal Information in accordance with the terms and conditions of this Privacy Policy. This Privacy Policy is incorporated into and subject to any terms of use posted on the Website (“Terms of Use”).

We have prepared this Privacy Policy to describe our practices regarding the information we collect, share and use through the website located at www.BlinkCrisisPR.com (the “Website”) and any services offered through the Website (the “Services”).

This Privacy Policy does not apply to information that we (or our affiliates) may collect on websites or applications other than the Website, including websites you may access through the Website, or any information that you provide to or that is collected by any third party.

We take your privacy seriously. Please read this Privacy Policy carefully to understand our policies and practices regarding your information and how we treat it.  If you do not agree with this Privacy Policy, you should not use the Website or the Services.

As used herein, the term “you” means each individual accessing the Website and the company on behalf of which such person is acting.

  1. Definitions

Anonymous Information” means data that is not reasonably linked to your Personal Information or your computer/device. Anonymous Information is created by manipulating or removing the reasonable link to personal identifiers or your computer/device. We collect Personal Information and Anonymous Information through the Website, as described below.

Personal Information” means information that allows someone to identify or contact you, including, for example, your name, address, telephone number, e-mail address, zip code as well as any other information about you that is associated with or linked to any of the foregoing data.

User Data” refers to any data, text, links, media, or other content that you submit to the Company via the Website.

We may change this Privacy Policy at any time.  We will provide you with notice of material changes (which notice may be made by us through the posting of the material changes on the Website or by other means of notice as permitted by the Terms of Use). We may, but are not required to, provide you with notice of non-material changes.  All updates and amendments are effective immediately upon notice, unless we state otherwise. We encourage you to review this Privacy Policy often to stay informed of changes that may affect you, as your continued use of the Website signifies your continuing consent to be bound by this Privacy Policy. Our electronically or otherwise properly stored copies of this Privacy Policy are each deemed to be the true, complete, valid, authentic, and enforceable copy of the version of this Privacy Policy which was in effect on each respective date you visited the Website.

  1. Information We Collect

(a) Information you voluntarily provide to us: When you sign up for and use the Services, send us an email or communicate with us in any way, you are voluntarily giving us information that we collect. That information may include your name, physical address, email address, phone number, and credit card information, as well as other demographic information. By giving us this information, you consent to this information being collected, used, disclosed, transferred and stored by us as described in this Privacy Policy.

(b) Information we collect automatically: When you use the Services or browse the Website, we may collect information about your visit to the Website, your usage of the Services, and your web browsing. That information may include your IP address, your operating system, your browser ID, and other information about how you interacted with the Website. We may collect this information as a part of log files as well as through the use of cookies or other tracking technologies. Our use of cookies and other tracking technologies is discussed more below.

(c) User Data: We will store and process the User Data which you provide on the Website for purposes of providing you the Services.

This type of information helps us to improve our Services for both you and for all of our users.

(e) Cookies and tracking: We and our partners use cookies and similar tracking technologies, such as pixels and web beacons, to analyze trends, administer the Website, track users’ movements around the Website and gather demographic information about our user base as a whole.   1. Use and Disclosure of Personal Information

We may use and disclose Personal Information only for the following purposes:

(a) To promote use of our services to you and others. For example, if you leave your Personal Information when you visit the Website and do not sign up for any of the Services, we may send you an email inviting you to sign up. If you use any of the Services and we think you might benefit from using another service we offer, we may send you an email about that. You can stop receiving our promotional emails by following the unsubscribe instructions included in every email we send. In addition, we may use information we collect in order to advertise our services to you or suggest additional features of our services that you might consider using. In addition, we may use your Personal Information to advertise our services to potential or other users like you.

(b) To send you informational and promotional content that you may choose (or “opt in”) to receive. You can stop receiving our promotional emails by following the unsubscribe instructions included in every email.

(c) To bill and collect money owed to us. This includes sending you emails, invoices, receipts, notices of delinquency, and alerting you if we need a different credit card number. We use third parties for secure credit card transaction processing, and we send billing information to those third parties to process your orders and credit card payments. (d) To send you system alert messages. For example, we may inform you of temporary or permanent changes to the Services, such as planned outages, new features, abuse warnings, and changes to this Privacy Policy.

(e) To communicate with you about your account and provide customer support.

(f) To enforce compliance with the Terms of Use and applicable law. This may include developing tools and algorithms that help us prevent violations.

(g) To protect the rights and safety of our subscribers and third parties, as well as our own.

(h) To meet legal requirements, including complying with court orders, valid discovery requests, valid subpoenas, and other appropriate legal mechanisms.

(i) To provide information to representatives and advisors, including attorneys and accountants, to help us comply with legal, accounting, or security requirements.

(j) To prosecute and defend a court, arbitration, or similar legal proceeding.

(k) To respond to lawful requests by public authorities, including to meet national security or law enforcement requirements.

This includes, for example, aggregating information from your use of the Services or visits to the Website and sharing this information with third parties to improve the Services. When we do have to share Personal Information with third parties, we take steps to protect your information by requiring these third parties to enter into a contract with us that requires them to protect the Personal Information we transfer to them and use it only in the manner set forth in our contract with them.

(m) To transfer your information in the case of a sale, merger, consolidation, liquidation, reorganization, or acquisition. In that event, any acquirer will be subject to our obligations under this Privacy Policy, including your rights to access and choice. We will notify you of the change either by sending you an email or posting a notice on the Website.

(n) To create and use Anonymous Information. We reserve the right to create and use Anonymous Information for any purpose and disclose Anonymous Information to third parties in our sole discretion.  We may create Anonymous Information records from Personal Information by removing or manipulating information that makes the data personally identifiable to you. We use Anonymous Information to analyze usage patterns of the Website and to enhance the content of the Services and improve the Website.

We will retain the Personal Information that we process for as long as needed to provide our Services or to comply with our legal obligations, resolve disputes, prevent abuse, and enforce our agreements.

  1. User Data

As you use the Services, you may import into our system User Data which consists of Personal Information of third parties. In such case, you are responsible for making sure you have the appropriate permission for us to collect and process information about those individuals. Consistent with the uses of Personal Information covered in Section 5, we may transfer Personal Information included in the User Data to companies that help us promote, provide, or support the Services (“Service Providers”). All Service Providers enter into a contract with us that protects Personal Information and restricts their use of any Personal Information as set forth in our contract with them.

  1. Public Information and Third Party Websites

(a) Public Forum. The Website may include a public blog or comment section. Any information you include in a comment on our public blog or comment section may be read, collected, and used by anyone. If your Personal Information appears on a blog or comment section on the Website and you want it removed, please contact us as noted below. If we are unable to remove your information, we will tell you why.

(b) Links to third-party websites. The Website may include links to other websites, whose privacy practices may be different from this Privacy Policy.  If you submit Personal Information to any of those sites, your information is governed by their privacy policies. We encourage you to carefully read the privacy policy of any Website you visit.

  1. Third Parties

We use third party Service Providers in order to provide and support the features of the Services, including credit card processing and website hosting services.  We disclose Personal Information to these Service Providers to help us operate the Website and the Services.  All Service Providers enter into a contract with us that protects Personal Information and restricts their use of any Personal Information as set forth in our contract with them.

  1. Safeguarding your Information; Credit Card Processing

We take reasonable and appropriate measures to protect Personal Information from loss, misuse and unauthorized access, disclosure, alteration and destruction, taking into account the risks involved in the processing and the nature of the Personal Information.

We use a third party payment processor to process payments made to us. In connection with the processing of such payments, we do not retain any personally identifiable information or any financial information, such as credit card numbers. Rather, all such information is provided directly to our third party processor, Stripe, whose use of your personal information is governed by their privacy policy, which may be viewed at https://stripe.com/us/privacy.

Website accounts require a username and password to log in. You must keep your username and password secure, and never disclose it to a third party.

  1. We Operate in the United States

Our servers and offices are located in the United States. Registered users of the Website and the Services must be located in the United States. However, our Service Providers may transfer your information out of the United States for purposes of assisting us with providing and maintaining the Website and the Services.

  1. Accuracy of Data

To the extent that you do provide Personal Information to us, we want it to be accurate. You may update your account information directly on the Website.

If your data changes (for example, if you have a new email address or credit card information), then you are responsible for notifying us of those changes.

We will retain your information for as long as your account is active or as long as needed to provide you with our Services. We may also retain and use your information in order to comply with our legal obligations, resolve disputes, prevent abuse, and enforce our agreements.

Under California Law, California residents have the right to request in writing from businesses with whom they have an established business relationship (a) a list of the categories of Personal Information, such as name, email and mailing address and the type of services provided to the customer, that a business has disclosed to third parties (including affiliates that are separate legal entities) during the immediately preceding calendar year for the third parties’ direct marketing purposes and (b) the names and addresses of all such third parties.   1. Use of Cookies and Other Technologies

From time to time, the Website may utilize “cookies” and other tracking technologies. When you visit the Website, we may place one or more “cookies” on your computer or other device. A “cookie” is a small text file that may be used, for example, to collect information about Website activity. Some cookies and other technologies may serve to recall Personal Information previously indicated by a visitor to the Website. We use cookies for all or any of the following purposes:

(a) To identify you when you access, visit, or log-in to the Website. This enables you to re-visit the Website without having to re-enter information upon each visit.

(b) To note different areas of the Website which have recently been accessed through your computer or device. Information collected in this way may be used to develop and manage the online services of the Company by, for example, storing information about your preferences so as to enable us to customize the Website according to your individual interests.

But, please note that if you choose to erase or block cookies, you will need to re-enter your original information (e.g., user name, password or general contact info) to gain access to certain parts of the Website and may not be able to access other parts of the Website.

We also use tracking technologies that record information such as Internet domain and host names; Internet protocol (IP) addresses; browser software and operating system types; clickstream patterns; and dates and times that the Website is accessed by visitors. We may also analyze information that does not contain Personal Information (or contains Personal Information in anonymous or aggregated form) for trends and statistics, such as through the use of Google Analytics or other similar analytics services.

You should be aware that your browser may have settings for Do Not Track.  We do not honor Do Not Track signals from browsers.  We support the position that many browsers’ default settings are set by their manufacturers and, therefore, do not represent the preferences of consumers.  However you may exercise your preferences as described in this Privacy Policy, including through the use of your device settings and blocking cookies.

  1. Children under the Age of 13
